Terms of Service (Lease Terms)

§ 1 Scope, provider

These terms govern all contracts for the temporary use of subdomains of the domain ck.gg ("lease") between Jack Fuchs, Am Dreisberg 3, 57520 Niederdreisbach, Germany ("provider") and the customer. Deviating terms of the customer do not apply.

§ 2 Service

The subject of the contract is the exclusive use of one subdomain of ck.gg (e.g. sta.ck.gg) for the agreed term, provided at the customer's choice via:

Setup takes place within 24 hours after the customer supplies the required technical details (in particular name servers). The contract does not transfer ownership of the domain ck.gg and does not entitle the customer to registration of a separate domain.

§ 3 Add-ons

Together with the lease, the customer may book one of the following add-ons at checkout. Add-on prices are annual prices as shown at checkout; they are charged for the selected term and are not discounted. The add-on shares the term and end date of the lease. In the self-service portal the customer may switch at any time between NS delegation and the mode of the booked add-on; switching to a different add-on is currently not possible.

§ 4 Exclusivity

Each word in the catalog is leased to at most one customer at any time. During an active lease the word is not made available to any third party.

§ 5 Conclusion of contract

The catalog does not constitute a binding offer. By completing checkout (Stripe) the customer submits an offer; the contract is concluded upon the provider's confirmation (payment confirmation).

§ 6 Term, renewal, termination

The term is 1, 2, 3 or 5 years at the customer's choice. The contract renews for the selected billing period unless terminated before the renewal date. Termination is possible at any time with effect from the end of the current period (by email or via the payment provider's channel). The right to extraordinary termination for cause remains unaffected.

§ 7 Word swap

Once per term period the customer may switch to another word of the catalog that is available at the time of the swap. Unused term is credited pro rata to the new word. If the new word is in a higher price tier, the customer pays the pro-rated difference; if it is lower-priced, the difference is credited towards the next renewal (no cash refund). The previous word returns to the catalog upon the swap. A swap cannot be used to hold both words at the same time.

§ 8 Continuity

The domain ck.gg is registered long-term; the provider maintains the registration for the duration of all active leases. During an active lease the leased name is never re-assigned. In the event of a sale of the domain ck.gg, the obligations under existing leases transfer to the acquirer.

§ 9 Customer obligations, abuse

The customer must not use the name for unlawful purposes. Prohibited in particular: infringement of trademarks or other identifiers, unlawful content, phishing, distribution of malware, and spam. In case of violations the provider may — after an unsuccessful request to remedy, or immediately for severe violations (in particular phishing/malware) — suspend the delegation and terminate the contract for cause. This protects every other customer on the domain. The customer is solely responsible for the content and services operated under the name.

§ 10 Prices, payment

The annual prices displayed in the catalog at the time of ordering apply, in euros. Multi-year terms are discounted (2 years −5 %, 3 years −10 % with a price lock, 5 years −15 % prepaid). Payment is processed by Stripe. There is no setup fee.

§ 11 Availability

The provider is responsible for maintaining the registration of ck.gg and the DNS delegation at registry level. The customer is responsible for the availability of the name servers, services and content the customer operates.

§ 12 Liability

The provider is liable without limitation for intent and gross negligence and for injury to life, body or health. For simple negligence the provider is liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for the contract. Liability under the German Product Liability Act remains unaffected.

§ 13 Right of withdrawal for consumers

§ 14 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of the state of the consumer's habitual residence remain unaffected. Should individual provisions be invalid, the remainder of the contract remains effective. The German version of these terms (/agb) prevails; this English version is provided for information.
